ALLEGED:
It was alleged that NG Harris, the rider of “Fritzy Boy” rode carelessly by allowing his mount to shift inwards when not clear, causing “Rochallen” (R Myers) to check and causing buffeting to “Alagant Satin” (S Spratt) and “Royal Flight” (Jay Misbah).
Rule 638(1)(d) reads as follows:
“A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless.”
THE EVIDENCE:
Mr Davidson, Stipendiary Steward, asked Mr J McLaughlin, Stipendiary Steward, to demonstrate the incident using the video coverage. Two views of the incident were shown from the back straight camera, which provided a head-on view, and also the side-on view. The incident happened shortly after the start. Mr Harris’ mount, “Fritzy Boy”, was drawn 11. Shortly after the start, Mr Harris moved on to other runners on the inside of him by shifting inwards when he was insufficiently clear. In the process, he caused buffeting to “Alagant Satin” and “Royal Flight” which had the impact of causing Ms Myers riding “Rochallen” to check.
Mr Harris was invited to comment on the incident, and he asked us to look at the actions of “Royal Flight”, which was racing approximately one horse width off the rail when there were no other horses inside it. He maintained that this horse was contributing to the buffeting which went on between it and “Alagant Satin”.
In response, Mr Davidson took the view that “Royal Flight” was entitled to its running line and that its actions were that of retaliation only.
SUBMISSIONS ON PENALTY
Mr Davidson informed the hearing that Mr Harris, as a senior and busy North Island rider, has an excellent record and the last time that he appeared on a charge pursuant to this Rule was in December 2009. He described Mr Harris’ degree of carelessness as mid-range, and submitted that a minimum suspension of four days (calculated on a national basis) should be considered.
In response, Mr Harris did not contest that a suspension should be imposed. He did not apply to have any period of suspension deferred in terms of the Rules.
PENALTY DECISION:
We delivered the following penalty decision on Race Day:
“Mr Harris has pleaded guilty at the earliest opportunity to a charge of careless riding. Mr Davidson, Stipendiary Steward, described the degree of carelessness as medium range. As a result of Mr Harris’ carelessness, at least three other runners were inconvenienced with one of those runners being checked. Thus, we agree that the degree of carelessness was medium range.
Having regard to the level of carelessness, and the fact that this was a Group 2 race for a stake of $250,000, we consider that the starting point for the imposition of penalty is a suspension of seven race days. We are, however, able to give credit to Mr Harris for his obvious excellent riding record and his early guilty plea, and the fact that he did not gain any advantage from his carelessness. Thus, we can build in a discounting factor of two race days. There are no other aggravating factors.
Thus, Mr Harris is suspended from race riding until the conclusion of racing today, 13 November 2010, until (and including) Wednesday 24 November 2010 - five days.”
