Jockey T Bau admitted a breach of Rule 530 (2) (B) in that he used his whip in an excessive manner prior to the 200 metre mark.

--Stipendiary Steward Mr Goodwin used the synchronized film both head and side on to show the alleged incident. He told the committee that Jockey T Bau’s use of the whip was outside the guidelines and he gave the horse a fair belt.
--Jockey T Bau agreed with a comment from the chairman that it looked bad. He told the committee it was in the heat of the moment and he got carried away when he realized he was in with a winning chance.
--MrGoodwin informed the committee that Bau had not been charged previously under the rule and that he did not get many rides. Mr Goodwin believed a fine would be appropriate but asked for a fairly substantial fine to reflect the seriousness of the incident.
--Mr Bau concurred that he did not get many rides and certainly not many winners. He was in a position to pay a fine but asked that it not be too high.
--DECISION AND REASON
--The committee in coming to its decision to impose a fine took into account Mr Bau’s record under this rule, his admittance of the breach and the fact that his riding engagements are not substantial.
--Mr Bau was informed his actions were outside the guidelines and that the fine must reflect the seriousness of the breach. A fine of $400 was imposed
