Hearing of information number 7876 filed under Rule 871(1)(d) by Mr Cameron George alleging careless riding by Mr V Colgan (Licensed Jockey)
--Following the running of Race 9, the Starcraft New Zealand Stakes, a Group 1 race, Mr V Colgan was charged with careless riding pursuant to rule 871(1)(d). It is alleged that he permitted his mount "Dezigna" to shift inwards near the 1500 metres when not sufficient clear of "Sharvasti" (N Harris) who was checked.
----Mr Colgan pleaded guilty to the charge which is, therefore, deemed to be proved.
----Mr Oatham, Assistant Stipendiary Steward, demonstrated the incident on three video films. It showed Mr Harris racing two off the fence about to commence a forward movement past another runner, when Mr Colgan angled his mount inwards and forced "Sharvasti" on to the running rail. There was a significant degree of contact.
----Mr Colgan said that he had been one off the fence but felt that he had been forced three wide and all he was trying to do was to keep his line.
----PENALTY DECISION
----Mr Colgan is a senior jockey who rides at a lot of race meetings throughout the North Island. In the past 12 months he has received two suspensions, one of three days on 11 November and one of four days on 26 December 2006.
----In this case, there were a number of aggravating features. In the first instance, the degree of contact to Mr Harris's mount was significant and had the potential for an accident. "Sharvasti" was forced from a two wide position and actually made contact with the running rail.
----The race was a Group 1 Stakes Race for a stake of $200,000.
----Taking into the account the provisions of Rule 1122(2) of the Rules of Racing, the penalty must reflect not only the seriousness of the incident but also the matters referred to in that Rule, namely:

Mr Colgan is suspended from the conclusion of racing on Wednesday 14 March until Thursday 29 March. That encompasses seven North Island meetings, that is to say a seven day suspension is imposed in that period.
