Mr P T Knowles, Stipendiary Steward, alleged that A J Suddaby, LADY FERN, drove carelessly when allowing his horse to move inwards on to number 1, TOP OF THE PILE, causing that horse to pace roughly and lose its position.
--Mr Suddaby admitted the breach of the rules.
--Stipendiary Steward Mr Allison showed video evidence from two positions. This showed the incident clearly. As Mr Suddaby attempted to ease into the trail Mr McLellan had already improved into that position; the movement by Mr Suddaby caused Mr McLellan to clip a marker post, take hold and briefly break. Under Rule 1111 (1) (d) I find the charge proven.
--Submissions as to penalty were heard. Mr Knowles said that Mr Suddaby had a clear record for the past 12 months and asked for a fine of $250. Mr Suddaby said he had admitted the incident and had no argument with Mr Knowles' submission.
--Taking Mr Suddaby's clear record and ready admission into account, I fine him $250.
