--DECISION AND REASON
----Stipendiary Steward, Mr S Larkins, alleged that Mr P Heywood (Starter) failed to declare a false start when ED?S DREAM (M Howard) struck interference in the run-up from FRANCO NERVOLO (SG Dickson).
----In evidence, Mr Larkins stated that FRANCO NERVOLO (SG Dickson) wobbled and broke, checking ED?S DREAM whowent back to a 3rd or 4th line position. He should have sounded the ?Recall?. As a result of the interference ED?S DREAM did not have time to recover its lost ground and was about 5 lengths back when the start was declared.
--Mr Heywood said he felt it was a 50/50 call, he felt the interference was slight and Mr Howard had made no effort to regain his correct position, he said he just drifted and he was being punished for his non-action.
----Mr Timpson, Starters Assistant, was driving the vehicle following the field. He agreed with Mr Heywood's assessment of the incident.
----Mr Larkins said as a result of the interference ED?S DREAM went rough and wobbled for several strides. He felt if the horse had been chased up it might have broken. The rule states "shall sound Recall, if there is interference."
----Decision
----The charge was found proven. Video evidence is clear that interference did occur and the rule is clear "shall sound Recall".
----Penalty
----Submissions as to penalty were heard. Mr Heywood had been fined $250 at Ashburton for the same offence on the Thursday of cup week. Accordingly, Mr Larkins asked for a fine of $500 as it was clear to him that Mr Heywood was careless with the rule again.
----Mr Heywood said if he was fined $500 he would give up the job.
----Taking all the above into account, Mr Heywood was fined $400. To this, Mr Heywood stated he would still resign.
