Under rule 871 (1) (d): An information was lodged by Stipendiary Steward Mr M Davidson alleging that apprentice jockey R Bishop, SPRING TIDE, shifted ground inwards when not sufficiently clear near the 350 metre causing a check to WILD CAT ridden by L Robinson.

Mr Robinson admitted the breach.

Stipendiary Steward Mr S Ching used several video clips of the incident, highlighting the inward movement of SPRING TIDE. Mr Ching stated that SPRING TIDE layed in on WILD CAT and was only three quarters of a length clear. Mr Bishop stated that he thought WILD CAT had the opportunity to take the gap, but in his opinion was not good enough.

Jockey Mr Wright confirmed Mr Bishop's statement.

In fixing penalty, the Judicial Committee was of the opinion that the level of carelessness was mid range. Consideration was also given to Mr Bishop's early guilty plea, and that Mr Bishop had been charged and found guilty under the same rule in July 2008 where he was suspended for three days.

On this occasion Mr Bishop has been suspended for 3 riding days from the conclusion of racing on 27th November 2008 to conclusion of racing on 10th December 2008.

NOTE: Mr Bishop took the opportunity of deferring his suspension until after the Canterbury JC meeting on 27th November 2008 under the seven day rule.
