Rule 869 (3) (b) was read and Mr Dickie confirmed through his representative Mr S Phelan that he did not admit the charge.

The lead-side and rear films were shown and commented on by Stipendiary Steward T Taumanu.
----
He pointed out the interference to the horses on Mr Dickie’s outside especially the interference suffered by Mr Doody’s drive. He also informed the committee of the positioning of the horses head as Mr Dickie angled for the gap turning the head out.
----
Mr Phelan told the committee that he believed Glamazon ran around, he was then corrected and hung in. There was interference but it was the fault of the horse.
----
Mr Dickie confirmed that as a Junior Driver he had 239 drives up to today. He stated he did drive the horse on the first day.
----
In summing up Mr Taumanu believed it was an error of judgement, if he had waited he was sure the gap down on the inside would have come.
----
Mr Phelan, in summing up believed the horse had a tendency to run around.
----
Decision and Reason:
--Revisiting the available films we are of the opinion that the sharp outward movement after he moved inwards and flattened the pylons contributed to and caused the interference to the horses on your outside.
----
There may be some slight mitigating circumstances in that after your inward movement you over-corrected, which caused the sharp outward movement. However as a Junior Driver with a substantial number of drives, it was your responsibility to drive within the rules.
----
We find the charge proven.

Submissions on Penalty:
--Stipendiary Steward Taumanu, because of serious breach of the rule, asked for a substantial fine of between $300 - $500 or a suspension.
----
Mr Dickie was adamant that he preferred a fine.
----
Decision and Reason:
--Mr Dickie, we have considered carefully your request for this charge to be handled by way of a fine. This breach has been handled by way of a fine on a number of occasions. You have not been charged under this Rule since April 2009 and we have taken this into consideration.
----
However your actions resulted in your drive being relegated after initially being provisionally placed 1st. The owners have of course lost the winners purse and being relegated to 5th, have finished officially outside the stake money. This will be of great disappointment to the connections – races are hard enough to win at any time.
----
Taking all things into consideration and agreeing to your request for a fine to be imposed to which the Stewards have agreed, we fine you the sum of $350.00.
