Information No. 67861 was filed by Stipendiary Steward, Mr S P Renault, against Licensed Public Trainer, Mr S J Adlam, alleging a breach of Rule 865 (2) in that he “failed to submit a notifiable gear form by the required time of 1 pm 8/4/09 (driver notification time) for REINDOWNE”.
--Mr Adlam had signed the Statement by the Defendant on the information form indicating that the breach was admitted and that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.
--Rule 865 provides as follows:
(2) A horse may race with different gear from its last start when the owner, trainer or person in control of the horse has notified the change in the manner prescribed in the Approved Gear Regulations. Any such change is to be advised not later than the official time for notification of drivers as specified in the Notification of Drivers Regulations.
Mr Renault informed the Committee that REINDOWNE, trained by Mr Adlam, had been paraded prior to Race 8 in half blinds. This gear was required to have been notified by 1.00pm on Wednesday, 8 April 2008 being the official time for notification of drivers for the meeting but was not so notified.
--Mr Renault recommended a fine of $50.
Mr Adlam was fined the sum of $50.
