Following Race 4 an information was filed pursuant to Rule 876 (1) when it was alleged by the informant Mr P Moroney that FOURWINNERS, placed 3rd by the judge, interfered with the chances of CAPE FEAR placed 4th by the judge.

Following Race 4 an information was filed pursuant to Rule 876 (1) when it was alleged by the informant Mr P Moroney that FOURWINNERS, placed 3rd by the judge, interfered with the chances of CAPE FEAR placed 4th by the judge. This was alleged to have occurred in the final straight. The margin between 4th and 3rd was 1 length.
--All connections were advised of the protest.

--CAPE FEAR : Mr P Moroney, trainer
--Mr M Coleman, rider
--Mr P Moroney demonstrated the video films and showed where his runner CAPE FEAR had his line taken by the inward movement of FOURWINNERS. He said FOURWINNERS had moved in 3 horse widths causing rider M Coleman to check his mount and lose momentum. He believed this cost CAPE FEAR more than a length, which is the margin he was beaten by.
--Mr Coleman, rider of CAPE FEAR, agreed with Mr Moroney and the interference cost him 3rd placing.
--Mr R Otto, trainer of FOURWINNERS, conceded his horse had moved inwards but said the 2nd horse had rolled in contributing to the check which CAPE FEAR had received. He believed however this did not cost CAPE FEAR a better placing.
--Mr Du Plessis confirmed Mr Otto's evidence, namely that the second horse had moved out as well.
--Mr Stevenson, owner of FOURWINNERS, said there was movement from all horses and was unimpressed with the protest.
--Chief Stipendiary Steward Mr C George, when asked for his assessment, agreed that CAPE FEAR did have its line taken but did not lose a lot of ground. He asked the Committee to consider the momentum lost by CAPE FEAR and whether that was sufficient to make up the length margin at the line.
--DECISION :
--The Committee carefully considered all evidence and reviewed the video films. We concede that CAPE FEAR did receive a check when FOURWINNERS moved into its line in the final 100 metres or so. However, we are clearly of the opinion that its chances of finishing in a better place were not affected. This is because we are satisfied that the momentum lost by CAPE FEAR and the subsequent ground he lost was not enough to convince us he would have made up the one length margin between 3rd and 4th at the post. Important in our deliberations was the manner in which both FOURWINNERS and CAPE FEAR finished off the race in the run to the line.
--Accordingly, the protest is dismissed and the judge's placings shall stand.
