Commencing his presentation the Informant clarified to the Committee that an absence of a head-on film hampered the proceedings and meant he would be referring to Trackside footage.

Stipendiary Steward J Oatham detailed the horses at the start, and the Committee observed that the gate for Magic Fox did not open in unison with the other gates.

Starter T Harrison advised the Committee that he had not noticed anything untoward at the start or received any relevant observations from staff.

Jockey S Collett was adamant that her mount had to force himself out of the stalls and had struck the gate with his head in doing so. Trainer J Collett stated that it was “quite visual” that that his horse, historically not a slow starter, had been denied a fair start, and had lost 2-3 lengths in the process.

Notwithstanding the absence of head-on video recording the start, the Committee was satisfied from their observations and the evidence of the jockey that Magic Fox had been denied a fair start when his gate did not open in unison with the other gates. In accord with that finding, and in terms of Rule 865A, Magic Fox was declared a “non starter”.
