| -- After race 1 Mr Knowles, stipendiary steward, instigated a protest into the 5th placing of VIALLI alleging interference at the 1500 metre mark to SIMON?S PRIDE placed 7th by the Judge. He sought relegation to behind SIMON?S PRIDE. Judge's placings were 9, 1, 3, 4, 8. ----Mr Knowles had the trainee stipendiary steward demonstrate on the head-on and side-on videos that at approximately the 1500 metre mark VIALLI improved on the inner of SIMON?S PRIDE when there was insufficient room, allegedly interfering with that horse as a consequence of it breaking when squeezed between VIALLI and the horse on its outer. ----Mr Knowles called Mr Norman, driver of SIMON?S PRIDE, who said that he was surprised a horse (VIALLI) was attempting to improve on the inside of him as there was no room. Mr Norman said he yelled out to give him room. Eventually he said his horse was squeezed and then broke. He said it was intention to take the trail and that he had done so when VIALLI kept coming. Mr Lowe who was in the one/one said he was surprised to see two horses on his inside and that he heard Mr Norman yell out. He agreed with Mr Norman that there was no room for Mr Kay to improve. ----Mr Kay said Mr Norman was half carting and could not make up his mind whether or not he wanted the trail. He never heard Mr Norman call. He said he was entitled to improve as he did and that he was "well in" when the interference occurred. ----I prefer the evidence of Mr Norman and Mr Lowe. The head-on video shows the leading horse was racing 1/2 a cart width off the markers with Mr Lowe improving on its outside. Mr Norman improved from wider on the track into the trailing position. As Mr Norman improved Mr Kay improved on his inner and in so doing was hard up against the markers and on one occasion he knocked one over. ----Mr Norman was hard up behind, trailing the leading horse when Mr Kay continued to attempt to improve on Mr Norman's inner. Eventually the inevitable happened and Mr Kay ran out of room with the result that SIMON?S PRIDE was squeezed and broke losing ground. Mr Kay continued to trail the leader, finishing fifth. ----I find that VIALLI interfered with SIMON?S PRIDE by improving into a gap which was never going to be wide enough to accommodate two horses. In so doing VIALLI interfered with the progress and chances of SIMON?S PRIDE by causing that horse to break and lose ground before settling after some 30 or 40 metres. ----In these circumstances I exercise my discretion and relegate VIALLI to behind SIMON?S PRIDE. Amended placings are 9, 1, 3, 4, 11. ----
