--Mr Knowles, stipendiary steward, protested against the 3rd placing of RAYMAUWHARRHEN SUN in race 5 on the ground that it broke from its gait approximately 60 metres from the winning post. The information alleged a breach of R 870(3), in that the horse failed to regain its correct gait.

Informant: Mr P Knowles stipendiary steward
--Defendant Mr P Williamson horseman
--Mr Knowles, stipendiary steward, protested against the 3rd placing of RAYMAUWHARRHEN SUN in race 5 on the ground that it broke from its gait approximately 60 metres from the winning post. The information alleged a breach of R 870(3), in that the horse failed to regain its correct gait.
--Judge’s placings were 16, 11, 17, 12, 9, 13.
--Mr Allison, stipendiary steward, demonstrated on the videos that RAYMAUWHARRHEN SUN, when leading, broke and continued in a gallop for a distance that the stipendiary stewards estimated to be 60 metres. We viewed the incident from 3 different angles but found that the side-on view was the most useful. This demonstrated that RAYMAUWHARRHEN SUN had broken just prior to 50-metre mark, as alleged by the stipendiary stewards. Mr Williamson, the driver of RAYMAUWHARRHEN SUN, and Mr Bartlett, the trainer and part-owner of the horse, stated it was close to the 50 metre mark and that they would leave it up to the Committee to determine whether or not it was before the 50 metre mark. Mr Williamson added the horse had never gained an advantage nor had it interfered with any other horse.
--We are satisfied that RAYMAUWHARRHEN SUN did break approximately 60 metres before the finish and continued in a gallop to the winning post. In these circumstances the horse has not promptly regained its gait. We exercise our discretion to disqualify RAYMAUWHARRHEN SUN pursuant to R 1003(2).
--Amended placings are: 16, 11, 12, 9, 13.
