Decision:
Following the running of Race 5, the Badlands Hanover At Nevele R Stud Pace, an information was filed by Stipendiary Steward Mr S. P. Renault against Mr B. E. Clark, Open Horseman, alleging a breach of Rule 869(2)(a), in that he used the whip excessively in the run home on his horse “Starlight Morgan” (15).

Following the running of Race 5, the Badlands Hanover At Nevele R Stud Pace, an information was filed by Stipendiary Steward Mr S. P. Renault against Mr B. E. Clark, Open Horseman, alleging a breach of Rule 869(2)(a), in that he used the whip excessively in the run home on his horse “Starlight Morgan” (15).
--Mr Clark had indicated on the information that he admitted this breach of the Rules, and he also agreed that he understood the charge and the Rule it was brought under. The charge was found to be proved accordingly.
--Mr Renault used video coverage to show that Mr Clark had used his whip on about 19 occasions over the concluding stages of the race. In explanation Mr Clark said that his horse was “real lazy” and that he was trying to finish in the first five to gain some form.
--Penalty:
--Mr Renault advised that Mr Clark had no relevant previous convictions, and recommended a fine of $200-00. Mr Clark had nothing relevant to say with regard to the recommended penalty. We were satisfied that the fine recommended was appropriate in this case, and accordingly Mr Clark was fined the sum of $200-00.
