An information was filed by Stipendiary Steward, Mr N G McIntyre, alleging that Licensed Public Trainer, Mr D A Taylor, had committed a breach of Rule 834 (1) & (2) (a) in that, as the trainer of SCOTLYNN NALE, an acceptor for Race 9, Murray Homes Design and Build Mobile Pace, he “scratched the runner after the official right of re-entry time due to being sold”.
DECISION AND REASONS:
--An information was filed by Stipendiary Steward, Mr N G McIntyre, alleging that Licensed Public Trainer, Mr D A Taylor, had committed a breach of Rule 834 (1) & (2) (a) in that, as the trainer of SCOTLYNN NALE, an acceptor for Race 9, Murray Homes Design and Build Mobile Pace, he “scratched the runner after the official right of re-entry time due to being sold”.

Mr Taylor had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach of the Rule and, secondly, that he did not wish to be present at the hearing of the information. The charge was found proved accordingly.

Mrs K R Williams, Stipendiary Steward, informed the Committee that SCOTLYNN NALE was scratched at 2.30pm on raceday, too late for any other acceptor to gain re-entry. In the case of Race 9, there were insufficient acceptors to require emergencies, so no other horse was denied a start as a result of the late scratching. Mrs Williams stated that Mr Taylor had acknowledged that he was aware of the requirement to scratch a horse before the right of re-entry time and had freely admitted the breach on this occasion. His explanation for the late scratching was that the horse had been sold. The Committee believes that the right of re-entry time for this meeting was 7.30am on raceday.

Mrs Williams referred to a previous case of a breach of the Rule in similar circumstances in which the trainer was fined the sum of $200. She sought a fine of $200 in this case.
