Following Race 2 an information was filed pursuant to Rule 876(1) when it was alleged by the informant, Mr M Baker, that CAGNEY placed 3rd by the judge interfered with the chances of XAAREALDEAL, placed 4th by the judge, in the final 200 metres of the race. The margin between 3rd and 4th was a long neck.

All connections were informed of the protest.

--

Present at the inquiry were the connections of CAGNEY, owner Mr M Rogers, trainer Mr ML Rogers and jockey Ms M Wenn. Connections of XAAREALDEAL present were owners, Mr D Li and Mrs M Simon, and jockey Mr C Grylls.

Mr George demonstrated the film, as Mr Baker was not present. He pointed out that when the runners reached the 200-metre mark, CAGNEY drifted out into the line of XAAREALDEAL when insufficiently clear. He showed Mr Grylls had to take hold of his mount, which cost him ground as a result.

Mr Li spoke on behalf of XAAREALDEAL and said their horse was hindered on several occasions and without the interference would have finished 3rd.

Mr Grylls, rider of XAAREALDEAL, said that at the 200-metre mark he had his line taken by CAGNEY on his inside. He said he had to take hold of his mount which he believed cost him from running third.

Mr Rogers, owner of CAGNEY, said that while CAGNEY drifted out he did not believe Mr Grylls was inconvenienced to any great degree.

--

Ms Wenn, rider of CAGNEY, conceded she did move out but it was a gradual movement and Mr Grylls had the entire straight to get past her.

--

Mr George said that it was obvious Ms Wenn had allowed her mount to move out when not the required distance clear, and as a result XAAREALDEAL was denied its rightful run to the post. He believed this cost XAAREALDEAL third placing.

The Committee carefully considered all the evidence and determined the following ?

  1. Interference did occur to XAAREALDEAL when CAGNEY moved out at the 200 metre mark, when not the required distance clear of XAAREALDEAL on its outside.
  2. --
  3. The Committee is satisfied that this interference did affect the chances of XAAREALDEAL finishing in a better place.

In exercising its discretion the committee has considered the check XAAREALDEAL received and the momentum he lost as a result. The margin of a long neck between third and fourth was also relevant and also the strong manner in which XAAREALDEAL finished the race. Accordingly, the protest is upheld and the placings shall now be ?
