Mr McKendry admitted the breach and did not wish to be present at the hearing.

Mr Muirhead demonstrated the incident by use of the video film. Mr McKendry obviously intended to restrain his horse to the rear of the field immediately after the start. However, he restrained the horse some distance before the actual start ad was some lengths from the barrier when the race started.

Penalty :
--Mr Muirhead said Mr McKendry had no relevant breaches of the rules recorded against him. He recommended a fine of $200.00. In fixing penalty the committee takes into account the following matters :

1. The guilty plea.
--2. The submissions of Mr Muirhead.
--3. The offending was in the lower half of the scale of seriousness.
--4 Mr McKendry’s clear record as far as this rule is concerned.
--5. The recommended starting point for penalty is $250.00.

Balancing those matters the committee imposes a fine of $200.00
