Following Race 7 an Information was filed pursuant to Rule 871 (1) (d). The Informant Mr Williamson alleged that Miss Wenn permitted her mount MIDIUM PROVIDES to shift inwards near the 1000 metres when not sufficiently clear of KEY MESSAGE (M Vance) who was dictated inwards causing crowding to LADY NEXUS, ELUSIVE LADY, DOWN LOADED, SO TAKE THAT and RUST.

Following Race 7 an Information was filed pursuant to Rule 871 (1) (d). The Informant Mr Williamson alleged that Miss Wenn permitted her mount MIDIUM PROVIDES to shift inwards near the 1000 metres when not sufficiently clear of KEY MESSAGE (M Vance) who was dictated inwards causing crowding to LADY NEXUS, ELUSIVE LADY, DOWN LOADED, SO TAKE THAT and RUST.
--Miss Wenn pleaded guilty to the charge.
--Mr Oatham demonstrated the video films which clearly showed Miss Wenn, riding MIDIUM PROVIDES, move inwards soon after the start and in doing so take the line of KEY MESSAGE when not the required distance clear. This caused KEY MESSAGE to also move in which resulted in several horses on her inside to be crowded. Mr Oatham did say however that KEY MESSAGE did appear to over react to the movement from Miss Wenn.
--Miss Wenn while admitting the breach reiterated that KEY MESSAGE had over reacted.
--PENALTY SUBMISSIONS
--Mr Williamson said that although Miss Vance had done her best to relieve the pressure on the horses on her inside several were quite badly hampered. He said Miss Wenn had incurred 2 suspensions in the last 12 months and had been fully cooperative with the stewards. He submitted that because of the mitigating factors described above this was at the low end of carelessness.
--Miss Wenn said she had commitments up to and including 16 May 09
--PENALTY
--The Committee considered all submissions and in particular the following:
--• Miss Wenn’s guilty plea
• Her record
• Mitigating factors in her favour namely that KEY MESSAGE moved in more than necessary because of over reacting.
Accordingly we impose a suspension on Miss Wenn from riding in races to start after the conclusion of racing on 16 May 09 and concluding after racing on 22 May 09 (4 days)
