Decision: Following the running of Race 6, Motukarara 20,000 Classic Richmond Workingmen’s Club Discretionary Handicap Pace, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Open Horseman, Mr G D O’Reilly, alleging a breach of Rule 869 (3) (b) in that Mr O’Reilly, as the driver of OUR JANE in the Race, “drove carelessly when shifting out with approximately 200 metres (sic) checking GREAT BALLS A FLYIN

Following the running of Race 6, Motukarara 20,000 Classic Richmond Workingmen’s Club Discretionary Handicap Pace, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Open Horseman, Mr G D O’Reilly, alleging a breach of Rule 869 (3) (b) in that Mr O’Reilly, as the driver of OUR JANE in the Race, “drove carelessly when shifting out with approximately 200 metres (sic) checking GREAT BALLS A FLYIN (B J Borcoskie)”.

Mr O’Reilly had signed the Statement by the Defendant endorsed on the information form indicating, firstly, that he admitted the breach of the Rule and, secondly, that he did not wish to be present at the hearing of the information. The charge was found proved accordingly.

Mr McIntyre showed video replays of the final stages of the Race. He pointed out Mr O’Reilly on OUR JANE, looking for a run early in the run home, move off the fence to the one-out line. Still looking for a run, he shifted out further and, in doing so, made contact with Mr Borcoskie on GREAT BALLS A FLYIN, who had got to the outside of Mr O’Reilly’s wheel, and caused that runner to be checked.

Mr McIntyre informed the Committee that Mr O’Reilly is a senior horseman and had not breached the Rule within the past 12 months. This season, to date, Mr O’Reilly has had 111 drives. Mr McIntyre stated that, in the view of the Stipendiary Stewards, Mr O’Reilly had made “an error of judgment in the lower to mid range”. He recommended a fine of $200.

The Committee took into account Mr O’Reilly’s admission of the breach and his previous good driving record. The fine recommended by Mr McIntyre was appropriate in all of the circumstances and Mr O’Reilly was fined the sum of $200 accordingly.
