The rule was read and both Mr Fieldes' acknowledged they understood it.

Mr Ray informed the Committee that Mr Fieldes had weighted out in an unapproved vest which he showed to the Committee. Mr Fieldes, when asked, freely admitted that was the vest as shown by Mr Ray that he had weighted out with.

The background was that Mr Fieldes had obtained the "Non Approved" vest from a South Island rider and that it was for the intention of saving approximately ½ kilo of weight. It was described by Mr Ray as a "Cheaper Vest".

Mr Fieldes (senior) for his part felt it was a foolish action by Mr Fieldes (junior) and that he could only say that his son had wanted to claim his 2 kilo allowance, but he would have accepted him being a ½ kilo over.

Mr Ray felt the breach warranted a term of suspension as fines of varying amounts did not seem to be a deterrent.

Mr Fieldes (senior) asked the Committee to consider a fine, as a term of suspension would only compound his son’s battle with weight.

--

Those present indicated when asked, that they had nothing further to add, that they had a fair hearing and left the Judicial Room for the Committee to arrive at a suitable penalty.

The Committee when arriving at a penalty took into account the following. Mr Fielde’s frank admission of the breach, his co-operation and honesty with officials and his youth.

The foregoing factors however were heavily out weighed by the seriousness of the breach and the deliberate intention to mislead.

--

A substantial fine was considered but in the circumstances felt to be inappropriate.

--

--

The Committee felt any penalty must show disapproval and a message to others that "Safety Vests" are to be worn for safety and must be of an "approved type" and that ample warnings have been given to riders that "Unapproved Vests" or vests that have been tampered with will not be tolerated.

--

Mr Fieldes may ride until the conclusion of racing on Saturday October 20th, and is then suspended for one calendar month until the conclusion of racing on November 20th 2007.
