DECISION AND REASONS:

Following the running of Race 8 Stipendiary Steward Mr S. C. Ching laid an information pursuant to Rule 871(1)(d) alleging Jockey L. McGregor (Shallow) rode carelessly.

--

The information reads as follows.

--

"I the abovenamed informant allege that the abovenamed Defendant

------

committed a breach of Rule 871(1)(d) in that L. McGregor the rider of Shallow shifted ground when not clear inside the final 200 metres causing Tiffany (J. Cameron) to be checked."

Rule 871(1)(d) reads as follows.

--

"(1) Every rider commits a breach of these Rules who in the opinion of the

--

Judicial Committee is guilty of riding which was:

--

(d) careless'."

Miss McGregor had indicated on the information that she admitted the breach of this rule, and she confirmed this at the hearing.

--

Stipendiary Steward Mr McLaughlin illustrated this incident by means of video recordings. The incident took place as described on the information and showed that Miss McGregor had moved outwards causing interference by forcing "Tiffany" onto the outside horse. Miss McGregor's horse was being ridden vigorously at the time and no attempt appears to have been made to avoid the interference.

Miss McGregor was given an opportunity to give an explanation regarding this matter but declined to do so.

PENALTY:

--

In relation to penalty Mr Ching advised the Committee that Miss McGregor should be given credit for her guilty plea. Mr Ching also advised that Miss McGregor had previous convictions for careless riding on 6 June 2005 at Foxton when she was suspended for 3 days, and on 1 February 2006 at Southland when she was suspended for 1 day and fined $750-00. Miss McGregor did not dispute these convictions. Mr Ching said that this breach was at the medium to high end of the scale of seriousness so far as careless riding is concerned, and that a suspension was called for.

Miss McGregor conceded that a suspension was an appropriate penalty.

--

We retired to consider the matter of an appropriate penalty.

--

DECISION ON PENALTY:

--

In determining the appropriate penalty we have taken into account that this was a relatively serious case of careless riding. To Miss McGregor's credit we take into account her guilty plea. We also, however, take into account that this is the third conviction for careless riding since June 2005, the most recent conviction being a month ago.

--

Taking all the above matters into account we determined that a term of suspension was an appropriate penalty in this instance.

--

Before retiring we had discussed with Miss McGregor and Mr Ching the upcoming meetings that Miss McGregor would be riding at. Although Miss McGregor usually rides in the South Island only, she advised that she has an engagement to ride a horse at the Wellington Racing Club's meeting on 18 March 2006.

On resuming the hearing we delivered the following oral decision.

--

"We have taken into account what Mr Ching has said in your favour in that you have pleaded guilty. We also of course take into account that you have had two charges in the last 12 months and in particular that in Southland you were suspended for one day and fined $750-00, and agree when you accept that a suspension is inevitable. We are going to suspend you from the completion of racing on Sunday (5 March) to after the completion of racing on 19 March which is effectively 5 days racing."
