Decision:

Following the successful protest brought by the Stipendiary Stewards after the running of Race 12, an associated Information was lodged against junior driver, M R Hay, the driver of Napa Valley.

Following the successful protest brought by the Stipendiary Stewards after the running of Race 12, an associated Information was lodged against junior driver, M R Hay, the driver of Napa Valley. The Information alleged a breach of Rule 869(7A)(a)(b), in that Mr M R Hay on Napa Valley improved on the inside of Roman Trickster when there was not sufficient room, striking 3 or 4 marker pegs with approximately 200metres to run.

Mr Hay admitted the breach and was assisted by Mr T Craddock, trainer of Napa Valley.

In respect to the circumstances of this matter, the committee referred to the evidence adduced at the protest hearing.

Regarding penalty, Mr Escott said Mr Hay did not have any previous breaches of this nature but he is an experienced junior horseman and, in this instance, he took an unnecessary risk. Taking into account the guilty plea, he recommended a moderate fine.

Both Mr Craddock and Mr Hay accepted the recommendation, and had no submussions to make.

In this case, and accepting the evidence adduced at the protest hearing, Mr Hay is appearing as a junior horseman, supported by Mr Craddock, on a charge under Rule 869(7A)(a)(b), in that he, driving Napa Valley, improved on the inside of Roman Trickster when there was insufficient room, striking 3 or 4 marker pegs.

Mr Hay admitted the breach, and he is to be given credit for that, as well as his conduct at the protest hearing. He also has a very good driving record and, in the circumstances, I am satisfied a fine, as recommended by the Stipendiary Stewards, is appropriate and Mr Hay is fined the sum of $200.00.
