DECISION AND REASON:

A protest was filed by Mr S Marr, the trainer of No.4, GIN RUMMY, who alleged that SQUARE PANTS or its rider, placed first by the judge, interfered with GIN RUMMY, placed second by the judge, inside the final 200 metres.

--

The parties all gave their evidence with regular reference to head-on and side-on video footage of the closing stages of the race.

In evidence, Mr Marr pointed out that GIN RUMMY had ducked away from the vicinity of Miss Parker's whip, thus losing momentum and ground. He alleged that GIN RUMMY had been struck twice on the head by Miss Parker's whip. He also stressed the final margin was a nose.

Mr Ormsby, the rider of GIN RUMMY, agreed with Mr Marr. He stated that SQUARE PANTS twice ran out and each time his horse received the whip in the face. Also to confirm SQUARE PANTS green-ness, he said that it had run in under pressure near the post.

Mr M Pitman, trainer of SQUARE PANTS, said that a lot of importance had been placed by Mr Marr on the alleged whip striking GIN RUMMY. He then asked Miss Parker "Did Mr Ormsby call out". She replied "No". Mr Pitman then asked, "Did you hit the other horse." Miss Parker replied that she "didn?t think so." Mr Pitman proceeded to question whether GIN RUMMY had in fact been struck by the whip, as the horse did not appear to react strongly. He also stated that even if the interference had occurred that there was sufficient time for GIN RUMMY to recover in the 200 meters run to the line. "The best horse on the day won the race", he concluded.

Miss Parker said when her horse rolled out she had stopped riding immediately. This was contested by Mr Marr who showed on the film that he felt as Miss Parker was only hitting her horse every second to third stride, that she had not changed her rhythm at all.

Stipendiary Steward, Mr S Ching, said Miss Parker's horse had moved out about half a horse width and the stipendiary stewards felt this had inconvenienced Mr Ormsby's horse. Mr Ching also felt it appeared that Miss Parker had struck Mr Ormsby's horse once or twice. He stressed this was accidental and was in close quarter riding. He showed side-on and front-on views several times to back up his statements. He also reminded the panel that the final winning margin was a nose.

Decision:

Having heard and considered all of the evidence presented and having reviewed the video footage available, the committee resolved to uphold the protest and relegate, No.7, SQUARE PANTS, to second and promote No.4, GIN RUMMY, to first.

In coming to this decision the committee:

  1. Accepted that GIN RUMMY had been inconvenienced by SQUARE PANTS or its rider, inside the final 200 metres of the race. This inconvenience was sufficient to justify the change of placings.

  3. GIN RUMMY was closing on SQUARE PANTS at the line.
  4. --
  5. Accepted (based on the evidence of Mr Ormsby and Mr Ching, and the video footage) that GIN RUMMY had been struck by Miss Parker's whip.

  7. Considered that any striking of GIN RUMMY by Miss Parker's whip was accidental, but nevertheless a consequence of SQUARE PANTS moving out around the 200 metre mark.
