Following the running of Race 12, Eureka Trust Handicap Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Trainer, Mr M E White, alleging a breach of Rule 864 (2) (d) in that “the off side rein on BELLE EYRE [trained by Mr White] came adrift in the running”.

Following the running of Race 12, Eureka Trust Handicap Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Trainer, Mr M E White, alleging a breach of Rule 864 (2) (d) in that “the off side rein on BELLE EYRE [trained by Mr White] came adrift in the running”.

Mr White was present at the hearing of the information and admitted the breach. The charge was found proved accordingly.

Rule 864 (2) (d) provides as follows:

--

(2)     Every horseman, owner, trainer and assistant thereof of a horse shall with regard to that horse ensure that:-

--

(d)     all gear is correctly applied and/or affixed so as not to malfunction or come adrift.

--

Mr Ydgren showed a video replay of the relevant portion of the Race. He pointed out BELLE EYRE, driven by R T May, racing towards the rear of the field. It was at this point that the rein became unattached from the bridle. Mr May had no option but to race up onto the back of the horse in front. Mr May was fortunate that he had that option, Mr Ydgren said. Mr May was able to take BELLE EYRE out of the field and avoid what could have been a serious situation. Mr Ydgren suggested that the rein probably was not put through the keeper prior to the horse’s going out onto the track.

Chief Stipendiary Steward, Mr N R Escott, submitted that a rein coming adrift was a much more serious situation than a hood or other gear malfunction. Mr May was very lucky to keep the horse on its feet. In the circumstances, the Stewards were recommending a fine of $200, he said.

Mr White stated that he was the person who geared up the horse and the only explanation was that he had been at fault in not securing the rein properly. Mr White had no submission to make in relation to the recommended penalty.

The Committee took into account Mr White’s very frank admission of the breach. However, it agreed with Mr Escott’s submission that a quite serious situation could have arisen as a result of Mr White’s omission, but for the horsemanship skills of Mr May. Furthermore, the betting public that had supported BELLE EYRE in the Race were denied a run for their money.

Mr White was fined the sum of $200.
