--Following the running of Race 9, the Great Menu @ Bailie’s Restaurant Handicap Trot, an information was filed by Stipendiary Steward Mr N. M. Ydgren against Mr G. R. Rich, Graduation Horseman, alleging a breach of Rule 869(2)(a), in that he used his whip in an unnecessary manner when striking “Spot of Gold” in the straight.

DECISION AND REASONS:
--Following the running of Race 9, the Great Menu @ Bailie’s Restaurant Handicap Trot, an information was filed by Stipendiary Steward Mr N. M. Ydgren against Mr G. R. Rich, Graduation Horseman, alleging a breach of Rule 869(2)(a), in that he used his whip in an unnecessary manner when striking “Spot of Gold” in the straight.
--Mr Rich had indicated on the information that he admitted this breach of the Rules, and also that he did not wish to attend the hearing.
--Mr Ydgren used video coverage to show that after entering the home straight for the last time, “Spot of Gold” went into a break, and shortly after Mr Rich struck the horse forcibly with his whip on one occasion. It was the Stipendiary Stewards’ case that the use of the whip in these circumstances was unnecessary.
--In relation to penalty Mr Ydgren advised that Mr Rich had no relevant previous convictions, and recommended a fine of $200-00. We were satisfied that the fine recommended was appropriate in this case, and accordingly Mr Rich was fined the sum of $200-00.
