The information alleges that I. Lupton permitted his mount SHERWOOD to shift inward near the winning post on the first occasion when not clear of ALL IN FAITH causing that runner to be checked and fall. SHRIVMANI also fell as a result. Rule 871 (1)(d).

The information alleges that I. Lupton permitted his mount SHERWOOD to shift inward near the winning post on the first occasion when not clear of ALL IN FAITH causing that runner to be checked and fall. SHRIVMANI also fell as a result. Rule 871 (1)(d).
--Mr Lupton was present at the hearing and did admit the breach.
--The rule was read and Mr Lupton acknowledged he understood same
--Mr Goodwin demonstrated head-on and side-on videos of the alleged incident and gave his interpretation of same.
--It was his view that just prior to the bend Mr Lupton had let his mount move in approximately a ½ horse width and into the line of ALL IN FAITH (L McFarlane) and that no runner outside Mr Lupton’s mount had forced it in. ALL IN FAITH was entitled to the line of running it had but Mr Lupton’s mount had come over into its line of running and it had clipped heals and fell, SHRIVMANI (G Walsh) went over the top of ALL IN FAITH and also came down.
--The videos shown to the committee clearly showed Mr Lupton’s mount move in approximately a ½ horse width.
--The Video also showed that the horses were racing very tight and on the point of a bend.
--Mr Lupton for his part said his horse may have changed leg and this could have caused it to move in.
--The Chairman asked for Mr Lupton’s record which Mr Goodwin said was very good, he was last charged under this rule on 6/9/08 where he was given 5 days suspension and prior to that was the 4/7/08 where he was given a 4 day suspension.
--Mr Goodwin told the committee Mr Lupton was a leading Jumps and Highweight Rider who rides all over the county has a lot of rides and causes no trouble with officialdom.
--Mr Lupton for his submission as to penalty told the committee he was committed to rides at Manawatu this Saturday the 13th June 2009.
--All parties acknowledged they had nothing further to add and left the committee to arrive at a penalty.
--Prior to arriving at a penalty the committee took into account Mr Lupton’s admission of the breach and his very good record, they also took into account that the horses were racing very tight and going into a bend and that Mr Lupton’s mount only moved in a ½ horse width, however Mr Lupton’s had let his mount move in when not sufficiently clear and the breach did warrant a term of suspension.
--Mr Lupton may fulfil his engagements at Manawatu on the 13th of June and is then suspended until the conclusion of racing on the 27th June 2009 (2 weeks)
