DECISION AND REASONS:
--Following the running of Race 10, Ashburton Club & MSA Pace, at the meeting of Methven Trotting Club at Mt Harding Racecourse, Methven, on 14 October 2007, Licensed Open Driver, Mr S G Dickson, was charged with a breach of Rule 869 (2) (a) in that he "used his whip excessively in the run home on HEAR ME OUT".
----The information was filed on raceday and adjourned sine die. It was heard at the meeting of New Zealand Metropolitan TC at Addington Raceway, Christchurch, on 16 October 2007.
----Mr Dickson was not present at the hearing of the information. He had signed the "Statement by the Defendant" on the information form acknowledging service of the information, that he admitted the breach and that he did not wish to be present at the hearing of the information. The charge was found proved.
----Nr N G McIntyre, Stipendiary Steward, showed a video replay of the run down the home straight. He pointed out Mr Dickson on HEAR ME OUT and alleged that Mr Dickson used the whip "all the way to the winning post". Mr McIntyre said that he counted 23 strikes with the whip which, he said, Mr Dickson did not dispute. This was confirmed by the video replay. Mr McIntyre alleged that this was excessive and, simply, too much.
----Mr McIntyre informed the Committee that Mr Dickson had not previously breached the Rule. He recommended a fine of $200.
----The Committee, taking into account Mr Dickson’s admission of the breach and his good driving record, accepted that the recommended fine was appropriate and Mr Dickson was fined the sum of $200.
