Decision:

An information instigating a protest filed by Stipendiary Steward Mr T Taumanu against KEYSTONE COPPER driven by Mr T Mitchell, placed 4th by the judge, on the basis of an alleged breach of Rule 869 (7B) in that its sulky wheel was inside the track marker line for more than 30 metres in the last 600 meters of the race. 



An information instigating a protest filed by Stipendiary Steward Mr T Taumanu against KEYSTONE COPPER driven by Mr T Mitchell, placed 4th by the judge, on the basis of an alleged breach of Rule 869 (7B) in that its sulky wheel was inside the track marker line for more than 30 metres in the last 600 meters of the race.  Mr Mitchell, who is also the trainer of KEYSTONE COPPER, represented the connections of the horse.

The information appeared to refer to rule 869 (7c) which relates to the same kind of breach prior to the last 600 metres of the race.  Mr Taumanu sought and was granted leave to have the information amended to read “869 (7b)”.

Mr Taumanu showed the video film of the incident.  About 350 metres from the finish, KEYSTONE COPPER was racing 4 back on the marker pegs trailing CARLOS driven by Mr S Lawson.  CARLOS moved inwards and its sulky wheel went over two or three marker pegs.  KEYSTONE COPPER followed CARLOS inwards and its sulky wheel went over and inside 5 marker pegs.  MR Taumanu said the marker pegs were 10m apart.

Mr Mitchell said that KEYSTONE COPPER followed CARLOS inwards.  He thought there was pressure from the outside on CARLOS.  He said KEYSTONE COPPER did not gain any advantage from the incident and should not lose its placing.  He said he had seen other horses do worse than his horse had done and not be disqualified.

DECISION AND REASONS
The Committee is satisfied from the video film that KEYSTONE COPPER’s sulky wheel went inside 5 marker pegs and thus was inside the track marker line for more than 30 metres.  Given this occurred in the last 600 metres of the race, the rule makes disqualification mandatory unless there was interference to KEYSTONE COPPER by another horse or horseman.  The Committee is satisfied there was no such interference.  The protest is upheld and KEYSTONE COPPER is disqualified, the final placings then being:-
