Hearing of information number 6272 filed under Rule 871(1)(d) by Mr SC Ching alleging that K Williams the rider of "Sand Sweeper" with approximately 1000 metres to run moved inwards when not sufficiently clear, causing tightening to "Mr Toff" (L Robinson), "Delbrae" (B Hibberd) and "Tee Cee" (JC Bates) with the latter being checked badly.
--Following the running of Race 9, Mr SC Ching the Stipendiary Steward charged Ms K Williams the rider of "Sandsweeper" with careless riding pursuant to Rule 871(1)(d) of the Rules of Racing. In support of his case Mr Ching called Mr L Robinson to give evidence who described how he pushed up inside Mr B Hibberd's mount when Mr Hibberd went to ease. His horse did not come back. Mr Robinson said that his horse then overreacted and that Ms Williams dictated his line or his stride and caused tightening. Ms Williams did not cross examine Mr Robinson on the evidence that he gave.
--Mr Ching then took us through the video coverage which showed how Ms Williams' mount rolled outwards and with Mr Robinson going up beside her. Then Mr Ching alleged that Ms Williams then rolled back causing the tightening.
--Ms Williams, in support of her case, called Mr JC Bates to give evidence, who stated to the committee that the tightening occurred before Ms Williams made her inward movement. He said that he was already under pressure and that "Fiscal Madness" took K Williams out for a stride or two.
--We have studied the video films carefully. We have no doubt that tightening occurred. Furthermore, it is abundantly clear that Mr Bates was placed in an invidious situation by the tightening that occurred. The evidence shows that the three horses were affected in the manner described in the information. The question for us to consider is did Ms Williams ride carelessly to such a degree as to be the causative factor in this incident.
--We are confident that she was not the causative factor. We note that Mr Robinson stated that he was only inconvenienced for a stride. We also note the evidence of Mr Bates who pointed out that Ms Williams was moved outwards by "Fiscal Madness" and that in Mr Bates' opinion he received the tightening from Hibberd and Robinson and that he was under pressure before Ms Williams rolled back in.
--Video coverage is inconclusive. We cannot reject Mr Bates' evidence in its entirety. That leaves us in a position of doubt.
--The charge was quite properly brought but because of our doubts, we cannot be satisfied that the charge is proved and it is dismissed accordingly.
