An information was lodged by Stipendiary Stewart Mr TW Taumanu against the third placing of Sonic Wing (Driver B Mangos) on the grounds of causing interference to Dakota Kid (Driver NA Chilcott) with approximately 150 metres to run.

An information was lodged by Stipendiary Stewart Mr TW Taumanu against the third placing of Sonic Wing (Driver B Mangos) on the grounds of causing interference to Dakota Kid (Driver NA Chilcott) with approximately 150 metres to run.

The protest was contested.

Present at the hearing were Mr P Springall the Owner Trainer of Sonic Wing and Mr BM Mangos the Driver as well as Ms NA Chilcott the part Owner, Trainer and Driver of Dakota Kid.

Rule 869 (4) states “no horseman nor any horse shall during any race do anything which interferes or is likely to interfere with any other horseman and/or horse or its progress.”

Rule 869 (4a) states “no horse shall during any race do anything which interferes or is likely to interfere with any other horse or it progress.”

--

Rule 869 (8) gives the Committee the power to relegate a horse which is the subject of a successful protest.

--

Evidence was given by use of the video film of the race and Stipendiary Stewart Mr JM Muirhead pointed out the positions of Sonic Wing and Dakota Kid turning for home.  Mr Muirhead pointed to the outwards movement of Sonic Wing with approximately 150 metres to run and showed where Dakota Kid had been squeezed up and had run out of room and broke.  Sonic Wing going on to be placed third in the race.

Ms Chilcott then gave evidence and she stated that although she did run out of room her horse was battling at that stage and wouldn’t have run in the money at all.  In answer to a question from the Chairman she said that she did not think that there was any contact from Mr Mangos’ horse or sulky.  In answer to a further question she also stated that she did not think that there was any contact from Mr Ferguson on the outside of her.  She stated that everything happened so fast that she wasn’t sure that there was contact at all but she did state that she had run out of room and that her horse might have overreacted but she again stated that in any event her horse was only battling.

Mr Mangos was then asked to give this Committee his version of the events.  He made use of the video films and pointed out to the positions of the various horses involved.  Mr Mangos in using the head on film pointed to the horse Satire (Driven by PC Ferguson) which was racing on the outside of Dakota Kid.  Mr Mangos pointed out that Mr Ferguson had moved albeit not a long way but that he had his inside sulky wheel “under the guts” of Ms Chilcott’s horse.  Mr Mangos believed that there had been contact between Mr Ferguson’s horse or sulky and Ms Chilcott’s horse or sulky.  Mr Mangos pointed out the inwards movement from Mr Ferguson and that the problem had already been caused when Mr Mangos began to move outwards.

In answer to a question Mr Mangos said that he had sufficient room to move out and that as far as he was concerned he did not cause interference to Dakota Kid nor caused it to break. He also said that there was no contact between his horse or sulky and Ms Chilcott’s horse or sulky.

At that stage Mr Taumanu considered the evidence that had been presented and asked this Committee if he could withdraw the protest.

The Committee consented to this and the protest was accordingly withdrawn.
