----An Information was laid by Stipendiary Steward Mr ESCOTT against Driver Mr W SCREEN alleging he drove LOTTA SOUL carelessly striking the back of the sulky of BE JAYS ATOM (P FERGUSON) with approximately 250 metres to run causing interference to his own horse during the running of Race 7
----Mr SCREEN appeared for the Hearing and admitted a breach of the Rule,
----Evidence was given by Mr ESCOTT that in the final stages of the race LOTTA SOUL struck BE JAYS ATOM heavily. in a manner he described as being at the top end of carelessness. This fortunately had little effect on BE JAYS ATOM, but caused Mr SCREENS drive to break up.
----Decision
----Finding the charge established, Mr ESCOTT submitted that Mr SCREEN probably averaged 6 or 7 drives for the season and that taking into account the breach was at the top end of carelessness requested a penalty of 2 months suspension
----Mr SCREEN that his driving was centred around the forthcoming grass track meetings and that a 2 months
--Suspension would put paid to his summer campaign which would possibly be up to 4 drives per meeting during the series of events.
----Mr ESCOTT submitted that any reduction in the suspension time should incur a monetary penalty to compensate and aid that in the normal course of events a full time driver would expect to receive a 3 to 4 day suspension. He agreed that Mr SCREENS Suspension up to the end of racing on the 4th January 2006 combined with a fine of $500 would address the issue.
