DECISION AND REASONS:
--Stipendiary Steward, Mr Allison, alleged Mr BR Shirley (GALVANO?S JAG) used the whip excessively over the final stages.
--Mr Shirley admitted the breach and under Rule 1111(1)(d), the charge was found proven.
--Video evidence was shown which confirmed Mr Shirley using the whip 26 times in the last 180 metres. He hit once, pulled the earplugs and then 25 times without respite.
--Mr Allison said Mr Shirley had not been charged under this rule for nine months. In that case the penalty was a fine of $250. In this case he wanted a suspension of two days.
--Mr Shirley said it was the same horse as last time. He said the horse kept giving everytime he hit the horse and kept coming to run third. He said the horse had not been in the money recently and it would be different if he was tailing off and was being hit out of anger. He also felt a suspension was severe, as this is his only form of income.
--Mr Allison said they would consider a fine as long as it was $400 or more.
--Decision:
--The committee pointed out to Mr Shirley that the guidelines have been drawn up and widely distributed. They were designed specifically for this purpose, and that Mr Shirley was in breach of the new guidelines.
--The committee acknowledged his ready admission of the breach and the fact that it is nine months since his last charge under this rule. Mr Shirley was informed that this charge will be on his record for 12 more months and he should be aware of this, should he consider breaching the guidelines again.
--Taking everything into consideration a fine of $350 was imposed.
