| -- An information lodged by Stipendiary Steward Mr J Muirhead following an investigation into the running of Race 6 at the Franklin Trotting Club Meeting at Auckland on the 26th November 2004, was heard at the Cambridge on the 1st December 2004. --Junior Horseman Mr J Abernathy was charged with driving HANDSHAKE in a manner capable of diminishing it chances of winning between 1250 and 1000 metres to run when he miscounted the number of laps to run. --Mr Abernathy was present and supported by Horseman Mr P Butcher. He pleaded guilty to the charge. --Mr Muirhead gave evidence supported by video tapes of the running of this race which clearly showed --Handshake being driven under whip on the home straight with a lap left to run. --Mr Butcher on behalf of Mr Abernathy in mitigation suggested that another driver could also be clearly seen driving his horse in a manner which suggested he too had miscounted and that this action had contributed to the error in counting by Mr Abernathy. --Following submissions on penalty by both parties and taking into account his driving record and matters raised in mitigation Mr Abernathy was fined $350. ---- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- I ------ -- -- --
