The information alleges that Mr T Sasada rode in an unapproved vest in Race 10.

--

--

Mr Sasada admitted the breach and was represented by his employer Mr D Haworth.

--

--

The rule was read and both Mr Haworth and Mr Sasada acknowledged they understood it.

--

--

Mr Sasada told the Committee he had ridden the previous day at Wanganui and his approved vest was very wet and uncomfortable. He was unable to get it in the dryer at Riccarton as there was only one available and seemed to be in use every time he went to use it.

--

--

Mr Haworth told the Committee that Mr Sasada was a good worker, diligent rider and deeply regretted his foolish action.

--

--

Mr Goodwin (Stipendiary Steward) emphasised that Mr Sasada had not used the UNAPPROVED VEST to gain any weight advantage as he (Mr Sasada) did not have a weight problem, he did, however, feel the breach warranted a term of suspension and a fine.

--

--

When arriving at a penalty the Committee took into account that it was Mr Sasada’s first breach of this rule, his admission of the breach, and the fact that he had not changed vests to gain a weight advantage.

--

--

However, the foregoing factors are heavily outweighed by the fact he had knowingly taken two vests to the races knowing that one was not approved, and had ridden in that vest.

--

--

Ample warnings have been given to riders that NON APPROVED VESTS are not to be worn. The rule is in place for the rider’s safety and Thoroughbred Racing personnel are to be congratulated for their vigilance in continuing to see this rule is not breached.

--

--

Any penalty must show disapproval and a clear message that UNAPPROVED VESTS or vests that have been tampered with will not be tolerated.

--

--

Mr Sasada may ride until the conclusion of racing on 3rd November 2007 and is then suspended until the conclusion of racing on 16th November 2007 (8 days). He is also fined the sum of $2000.00.
