An information filed by Stipendiary Steward Mr J Muirhead against Junior Driver V Blanchard, driver of LE SPOT, alleging a breach of Rules 869 (4) and (6)(b)(c) –Push out – in that he improved his horse outward from four deep on the running line with about 1150m to run forcing MANOTICK EXPRESS, driven by Ms M Shephard and SUPREME JENCOL, driven by Mr R Butt, to race wider on the track.

--Mr Blanchard admitted the breach and was present at the hearing assisted by Trainer Mr J Crouth.
--Mr Muirhead demonstrated the incident by use of the video film. GOLD COAST, driven by Mr H Cullen, was in the one one position and moved outwards. LE SPOT was on the inside of GOLD COAST and moved outwards to take up the position vacated by GOLD COAST, however, MANOTICK EPRESS was following GOLD COAST and was forced to race wider on the track as was SUPREME JENCOL which was racing outside MANOTICK EXPRESS.
--Mr Blanchard said he thought he was clear to move outwards because he thought MANOTICK EXPRESS was going to follow GOLD COAST. Mr Crouth said he thought it was a minor breach of the rule because MANOTICK EXPRESS seemed to start to follow GOLD COAST.

PENALTY
--Mr Muirhead said Mr Blanchard had a clear driving record and although the recommended starting point was a fine of $250.00, he was recommending a fine of $200.00 taking into account the guilty plea. Mr Blanchard had no comment to make on penalty. In fixing penalty I take into account the following :
--1. The guilty plea.
--2. The submissions of Mr Muirhead.
--3. The comments of Mr Blanchard and Mr Crouth.
--4. Mr Blanchard’s clear driving record.
--5. The offending was about midpoint on the scale of seriousness – two horses were forced to race wider on the track.
--6. The recommended starting point of a fine of $250.00.
--7. Mr Blanchard is a Junior Driver.
--Balancing all of those matters I impose a fine of $200.00.
