CHARGES:

Mr M Jones was charged under rule 869 (4) in that when driving Jayee’s Magic, he drove in a manor causing interference racing into the first bend when tightening Lady Gaga(driver B Barclay) for racing room causing it to strike pylons and break.  Mr Jones admitted the breach and was present at the hearing.

FACTS/SUBMISSIONS:

Mrs Williams and Mr Jones agreed that the facts presented in the protest hearing (information 13943) were a true and accurate record and that no further evidence was required from that hearing.

DECISION:

--

The committee was satisfied a breach of the rule had occurred. The reasons were clearly outlined in the earlier protest hearing.

--

SUBMISSION(s) ON PENALTY:

--

Mrs Williams told the committee that Mr Jones had been fined under the same rule at the Auckland Premier meeting $400 in a group race.  Mrs Williams recommended a fine between $300-$400.

--

Mr Jones said that the video evidence looked worse than what the incident was and that he had made an error of judgment when moving in when not sufficiently clear of Lady Gaga.  Mr Jones said that he was a busy driver, driving both in the South and North Island and was normally having 6-7 race drives on any one night.

PENALTY:

--

Mr Jones was fined the sum of $300.  The committee when fixing penalty took into consideration Mr Jones’s guilty plea and his busy race day driving schedule.
