DECISION AND REASONS:
--An information instigating a protest lodged by Stipendiary Steward Mr J Muirhead on behalf of WESTBURN SPLASH placed 3rd against TYLER?S IMAGE placed 1st, on the grounds of interference in the home straight. Mr Muirhead demonstrated the incident by use of the video film. He said TYLER?S IMAGE which led into the home straight, moved inwards into the passing lane and caused interference to WESTBURN SPLASH and preventing that horse having clear access to the passing lane. Mr S Phillips, trainer of TYLER?S IMAGE, said that there was still room for WESTBURN SPLASH to improve and even though it was hit with the whip it did not respond and was not going well enough. Miss J Compain, driver of WESTBURN SPLASH, said she attempted to take the gap but the horse turned its head and wanted to trail TYLER?S IMAGE. She said WESTBURN SPLASH would have got second but for the interference. Miss A Matthews, driver of TYLER?S IMAGE, said there was plenty of room for WESTBURN SPLASH to improve but it was not good enough.
--The Committee found the following matters established:

- TYLER?S IMAGE did move about a half sulky width into the passing lane but there was still enough room for WESTBURN SPLASH to improve in the passing lane. --
- WESTBURN SPLASH was initially slightly inconvenienced by the inward movement of TYLER?S IMAGE, but did not want to take the gap, instead wanted to trail TYLER?S IMAGE.
Having found that there was a breach of the Passing Lane regulations, and, therefore Rule 869(4), the Committee has to consider whether to exercise its discretion to relegate TYLER?S IMAGE. Having taken into account that the interference was only minor and the inconvenience to WESTBURN SPLASH was slight, and also that the margin between second and third placings was two lengths, the Committee were far from satisfied that it should exercise its discretion and therefore, dismissed the protest.
