Following the running of Race 8, the Robbie’s Bar & Bistro 2yo Emerald, an information was filed by Chief Stipendiary Steward Mr N. R. Escott against Mr D. J. Butt, the driver of FIVE STAR ANVIL (11), alleging that he had committed a breach of Rule 869(2)(a) in that he used his whip excessively.

Following the running of Race 8, the Robbie’s Bar & Bistro 2yo Emerald, an information was filed by Chief Stipendiary Steward Mr N. R. Escott against Mr D. J. Butt, the driver of FIVE STAR ANVIL (11), alleging that he had committed a breach of Rule 869(2)(a) in that he used his whip excessively.
--Mr Butt had indicated on the information that he admitted this breach of the Rules and that he did not wish to attend the hearing.
--Mr Escott gave evidence and used video coverage to show that Mr Butt used his whip on about 25 occasions throughout the run home.
--Penalty:
--In relation to penalty Mr Escott advised that Mr Butt had no previous convictions for a breach of this Rule and recommended a fine of $300-00.
--We were satisfied that a fine of $300-00 was appropriate in this case, and accordingly Mr Butt was fined the sum of $300-00.
