Following race 10 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant , Mr J P Oatham, that Mr A Calder, the rider of GOLD MEMBA , committed a breach of that rule

DECISION & REASON

--

Following race 10 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant , Mr J P Oatham, that Mr A Calder, the rider of GOLD MEMBA , committed a breach of that rule when he allowed his mount to roll in when being ridden with the whip 150 meters from the finish causing a check to KENADAAD who was ridden by Miss L Hoffman.

Mr Calder did not admit the offence.

Mr Oatham called two witnesses, Mr Coles, Stipendiary Steward, and jockey Miss L Hoffman, rider of KENADAAD. Mr Coles demonstrated on race video Mr Calder's mount moving inwards at least 2 horse widths and dictating the line of Miss Hoffman's mount, KENADAAD. Consequently KENADAAD was badly checked. Mr Cole said that Mr Calder crossed on his mount when not sufficiently clear. He also said there was slight outward movement from the horse inside of KENADAAD.

Mr Calder did not question Mr Coles evidence.

Miss Hoffman gave evidence that inside the 200 meter mark she suffered interference when Mr Calder's mount rolled in and dictated her line. Miss Hoffman confirmed the evidence of Mr Coles.

Mr Calder, in his evidence, demonstrated on the video the incidents and said he stopped riding twice and also claimed that the inside horse contributed to the interference. He contended that although his horse did run in, he was not careless.

DECISION: Having reviewed the evidence we prefer that of the informant. Mr Calder's riding was careless in that he continued to ride his mount when it was on an inward course when not sufficiently clear of another runner.

--

Accordingly we find the charge of careless riding proved to the required standard.

PENALTY: We have considered all submissions, and have taken into account:

  5. No credit for a guilty plea.

We do not accept Mr Calder's submission that a fine is appropriate, but do accept Mr Oatham's submission that a suspension is appropriate.

Accordingly we suspend Mr Calder from the conclusion of racing on 3 August till the conclusion of racing on 11 August 2005, effectively 4 days.
