Following the inquiry into Race 5, Mr RAB Norvall was charged pursuant to Rule 871(1)(d) of the Rules of Racing (careless riding).
| -- The Facts --Following the inquiry into Race 5, Mr RAB Norvall was charged pursuant to Rule 871(1)(d) of the Rules of Racing (careless riding). --Mr Norvall admitted the breach. --It was agreed by Mr Ching and Mr Norvall that the evidence presented in the inquiry be taken as the evidence for this hearing. Neither Mr Ching nor Mr Norvall had anything to add, with regard to the incident. --In brief, Mr Norvall's mount rolled in on the 4th placed horse, causing interference to it and as a result the protest was upheld, and Mr Norvall's mount was relegated to 4th place. --Penalty --Mr Ching informed the hearing that Mr Norvall had an excellent riding record and that he had not appeared in the Judicial Room for over 18 months. Nonetheless, because there had been a relegation, Mr Ching submitted that a suspension should be imposed. He agreed that credit should be given for an early guilty plea. If there was to be a fine, it should be substantial. Mr Norvall's preference was for a fine. --Our firm view is that a suspension is the proper penalty in this instance. Mr Norvall's mount caused interference and the protest was upheld. Furthermore, because there was contact, the issue of rider safety is involved and there could possibly have been a fall. --Mr Norvall is therefore suspended from the completion of racing on 20 April 2005 (the Rotorua meeting where Mr Norvall is riding) until the conclusion of racing on 27 April 2005, effectively 3 days. |
