This information alleged a breach of Rule 871(1)(d) for careless riding by jockey, C. W. Treymane (ENVEE), in that she shifted out when not the required distance clear of CHILL (B.R. Jones). The breach was admitted.

Stipendiary Steward, J Oatham, demonstrated the incident on video, showing Ms. Treymane as ENVEE rounded the bend into the straight in the lead. Her mount shifted outwards causing a severe check to CHILL and also buffeting to GALLIONS REACH (G. Cooksley) and to CHARLIEHORSE (C. Ormsby). Ms. Treymane was never clear of these runners and although she took corrective action it was too late to prevent the respective sharp checks which resulted.

Ms. Treymane explained that ENVEE had not made the turn well and had been shying in the back straight. She had tried to keep straight as he was going well but he ducked quite sharply on her before she could take the necessary corrective action. She called Jockey G. Cooksley to confirm her circumstances and he confirmed that there had been a sudden outward movement and he saw the horse concerned with its head turned in as Ms. Treymane took corrective action. He confirmed she had not been using the whip although she had been pushing it forward but it had all happened too late for him to avoid losing ground.

Mr. Coles informed the Committee that Ms. Treymane had been suspended previously on 24 September 2005 for three days at Taranaki but otherwise had a good record over the last nine months. He accepted the actions of the horse had not helped her but the check was severe and he believed a suspension had to be imposed.

Ms. Treymane confirmed that she expected to have engagements for the coming Ellerslie and Taupo meetings including the City of Auckland Cup on 1 January 2006.

The Committee took into consideration these matters and giving credit for the guilty plea, difficulties with the ride and good record nevertheless agreed a period of suspension had to be imposed as it had been a severe check affecting more than one horse.

Accordingly suspension for three days was ordered from after racing on 27 December 2005 until after racing on 1 January 2006 which involved Ellerslie (Thursday), Taupo (Saturday) and Ellerslie (Monday).
