At the outset of the hearing it was noted that Mr James admitted the breach and did not wish to appear.

The Stipendiary Stewards showed the video evidence of the last 200 metres of the race and asked the Committee to note that Mr James, in a continuous way, used his whip at least on 22 occasions.

The breach is, accordingly, found proven.

The Stipendiary Stewards advised the Committee that:

· Mr James had admitted the breach at the earliest opportunity, and
--· He had no similar breaches over the last 12 months
----
The Stipendiary Stewards recommended a fine only and, Mr James is fined the sum of $200.
