Decision:

At the meeting held on 14th March 2008 the Stipendiary Stewards lodged an Information against amateur Jockey, D Champion, alleging a breach of Rule 1002 (1) (b) in that she rode track work at the Ashburton track on Thursday 13th March 2008 without an approved body protector as required under the direction given under Rule 158 (1) (a).

At the meeting held on 14th March 2008 the Stipendiary Stewards lodged an Information against amateur Jockey, D Champion, alleging a breach of Rule 1002 (1) (b) in that she rode track work at the Ashburton track on Thursday 13th March 2008 without an approved body protector as required under the direction given under Rule 158 (1) (a).

At the outset of the hearing the Committee noted that the Defendant admitted the breach and did not wish to be heard, this being confirmed in writing. The charge is accordingly found proven.

Mr Ching advised the Committee that on 13th March 2008 he had been at the Ashburton Racecourse on a pre-race day check of the course and noted two horses leaving the track, one of which was ridden by D Champion and that neither rider, both being licensed persons, had an approved safety vest on.

Mr Ching advised the Committee that the Stipendiary Stewards view was that the failure to wear the approved gear was a flagrant breach of the licensed person’s responsibility under the rules of racing and that personal safety was at issue.. In respect of penalty Mr Ching submitted that in his view a monetary fine only should be imposed on this occasion but that the level of the fine had to reflect the seriousness of the breach.

The Committee, after given consideration to the submissions by the Stipendiary Stewards and allowing credit to the Defendant for the early guilty plea, imposes a fine of $350.00.
