Following the running of Race 5, the Caduceus Club of Canterbury Mobile Pace, an Information was laid by Stipendiary Steward Mr N. G. McIntyre alleging that Mr G. D. O?Reilly committed a breach of Rule 869(7A)(c).

DECISION AND REASONS:
--Following the running of Race 5, the Caduceus Club of Canterbury Mobile Pace, an Information was laid by Stipendiary Steward Mr N. G. McIntyre alleging that Mr G. D. O?Reilly committed a breach of Rule 869(7A)(c). The information reads as follows.
------"I the above named informant allege that the above named Defendant committed a breach of Rule 869(7A)(c) in that G. D. O?Reilly in attempting to move inwards forced Jamie (K. M. Barron) over a number of pylons racing into the first bend."
--Rules 869(7A)(c) reads as follows.
--"(7A) Every horseman who moves inwards shall ensure:
--- --
- (a) ?.
(b) ?.
--(c) that the movement does not cause any other horseman, horse or sulky to contact any track marker or protrude inside the marker line.
--It shall be a defence to a breach of this sub-rule if the horseman establishes that the breach was attributable to the behaviour of his own horse or any other horse or horseman in the race."
--Mr O?Reilly had indicated on the information that he admitted this breach and he confirmed this at the hearing. Mr McIntyre showed video coverage of the incident.
--Penalty: Mr McIntyre advised that Mr O?Reilly had no previous relevant convictions. Mr McIntyre also said that this was a $25,000-00 race on a Premier night and a fine of $300-00 was recommended.
--Mr O?Reilly thought that the fine recommended was too high.
--We retired to consider our decision. After considering the matter we were satisfied that a fine of $300-00 was appropriate in the circumstances and Mr O?Reilly was fined the sum $300-00 accordingly.
