Decision: At the Foxton Racing Club meeting on 17 July 2008 Information 6694 was filed pursuant to Rule 871(1)(d) alleging that Ronald Stam, the rider of BEE GEE has allowed his mount to shift outward when not the required distance clear of BALLINHAND
At the Foxton Racing Club meeting on 17 July 2008 Information 6694 was filed pursuant to Rule 871(1)(d) alleging that Ronald Stam, the rider of BEE GEE has allowed his mount to shift outward when not the required distance clear of BALLINHAND (Jarrod Todd) resulting in that horse being checked in the home straight.

Mr Stam admitted the breach of the rule.

Mr Goodwin showed the films and said that at approximately the 250 metre mark Mr Stam’s horse, which was in or very near to the lead, was racing greenly under a vigourous ride and ran out under pressure causing Mr Todd on BALLINHAND to be checked. He stated that at no time did Mr Stam stop riding and make any attempt to straighten his horse.

Mr Stam stated that he had nothing to say on Mr Goodwin’s interpretation of the films.

Decision and Penalty

Mr Goodwin advised that Mr Stam had been suspended twice in the current season under the same rule having been given a 5 day suspension in August 2007 and a six day suspension in April 2008. Mr Goodwin indicated he thought this offence was not at the “top end of the scale” and that a suspension of not less than four days would be appropriate.

Mr Stam confirmed that he only rides in the Central Districts and when asked about his upcoming engagements confirmed he had none in the next 7 days.

After reviewing the films and considering the submissions made the Committee took into account Mr Stam’s admittance of the breach and that the breach was not at the top end of the scale but also that there was considerable outward movement by Mr Stam’s horse and that he made no attempt made to straighten it.
----
Mr Stam is suspended from racing from the conclusion of racing on Thursday 18 July 2008 to the conclusion of racing on Thursday 31 July 2008 that being 4 Central Districts riding days.
