Decision:
Following the running of race 8 an information was filed by Stipendiary Steward Mr J Oatham (Informant) that alleged that trainer Mr S Clotworthy, trainer of JUNGLE BOY failed to gain permission to race his horse in a shadow roll.

Rule 868 (3) provides as follows:- “A horse which ran without any of the notifiable gear.....in a flat race shall not run without such gear unless the race is a jumping race or permission to run the horse without such racing gear has been obtained from a Stipendiary Steward....”
--Rule 868 (5) provides as follows:- “Every trainer commits a breach of these rules if a horse trained by him is run or attempted to be run in any race.....other than in accordance with the last permission (if any) from a stipendiary steward pursuant to sub rules 2 or 3 of this rule whether or not such permission was obtained in respect of such race”

Mr Clotworthy signified that he admitted the breach and indicated he did not wish to be present at the hearing.

The charge is thus found to be proved.

DECISION AND REASONS

Mr Oatham recommended a fine of $100. The committee concurred. Mr Clotworthy is fined the sum of $100.
