Decision:

The information alleges that BANG BANG or its rider placed second by the Judge caused interference to TICK TOCK TURBO placed third by the Judge.

The alleged interference occurred a the 200 Metre Mark.  The respective riders were BANG BANG, D Walsh, and TICK TOCK TURBO, B Herd.   Both were present at the hearing as too was Ms L Latta the OWNER/TRAINER of TICK TOCK TURBO.     Mr Walsh was representing the connections of BANG BANG, the part-owner and trainer of that horse.    Mr J Scott was other wise engaged but did arrive at the hearing after the reading of the rule.

The margin between the two horses at the finish was a nose.

The rule was read and those present acknowledged they understood same.

Mr George demonstrated Head-on and Side-on films of the alleged incident and said it was his opinion that BANG BANG had taken the line of running that TICK TOCK TURBO was entitled to, and the films clearly showed this.

None of the persons present had any questions of Mr George nor did they wish to question his interpretation of the films shown.

Mr Walsh for his part, said there was no doubt his horse had run out, but no contact had been made, he felt the track was better further out where Mr Herd had been forced to go and it would be a 50/50 call.

Mr Herd said for his part, he had no doubt had he not been forced to change ground he would have beaten BANG BANG.

Mr Scott and Ms Latta were given the opportunity to speak but both were happy that their respective riders had put their case for them.

In summary Mr George said the Stewards had identified where the interference had occurred and it was their opinion that the protest should be upheld bearing in mind the margin was a nose.

Those present acknowledged they had nothing further to add and were happy they had been given a fair hearing and left the Committee to arrive at a decision.

--

Prior to arriving at a decision the Committee took into account all of the evidence, both verbal and the films shown to them.

--

They did not subscribe to Mr Walsh’s theory that by moving out he had in fact put TICK TACK TURBO onto better going nor did they see it as a 50/50 call.  BANG BANG had inconvenienced TICK TICK TURBO, forced that horse to change ground and in doing so  cost it valuable ground.  The margin between the two horses at the finish was a nose, and they were in no doubt had TICK TACK TURBO not been forced to change ground it would have beaten BANG BANG to the WINNING POST.   The protest was therefore upheld.

The horse BANG BANG was placed immediately behind TICK TACK TURBO and the amended placings were 2-3-9-10-8-4.  TICK TOCK TURBO being horse 3 and BANG BANG horse 9.
