Following Race 9 an Information was filed pursuant to Rule 871(1)(d) when it was alleged by the Stipendiary Steward, Mr LN McCutcheon, that Mr K Smith, the rider of JINGLING allowed his mount to shift in soon after the start and severely check CHARMAINE ridden by Mr A Calder.

DECISION AND REASON:

Following Race 9 an Information was filed pursuant to Rule 871(1)(d) when it was alleged by the Stipendiary Steward, Mr LN McCutcheon, that Mr K Smith, the rider of JINGLING allowed his mount to shift in soon after the start and severely check CHARMAINE ridden by Mr A Calder.

Mr Smith pleaded guilty to the charge.

Mr McCutcheon demonstrated both films and showed Mr Smith move in when not sufficiently clear and in doing so cause a severe check to Mr Calder who was barely a length behind him and on his inside.

PENALTY:

--

Mr Smith said his horse was a first starter and raced greenly. He said he misjudged the distance. He said he preferred a fine, as he had some good rides at Gisborne.

Mr McCutcheon produced Mr Smith's record, which was a good one with his last suspension on 15 October 2003, a suspension of 3 days. However, he believed the offence warranted a suspension as Mr Calder received quite a severe check.

The Committee considered all submissions and agreed a suspension to be the correct penalty, as Mr Calder was in trouble for some time as a result of Mr Smith moving in when not the required distance clear.

Accordingly, we suspend Mr Smith from riding from after the conclusion of racing on the 22 September 2004 until after the conclusion of racing on the 26 September 2004, a period of 3 days.
