Information 5579 was filed by Chief Stipendiary Steward Mr R Sanders against Mr T Ihaka under rule 871 (1)(d) alleging that “ T Ihaka permitted his mount TEXAS to move inward when not clear of MR CHARLTON (G Walsh) near the 900m causing MR CHARLTON to be checked”.

Rule 871(1)(d)) states “Every rider commits a breach of these rules who in the opinion of the Judicial Committee is guilty of riding that was ......careless”.



Information 5579 was filed by Chief Stipendiary Steward Mr R Sanders against Mr T Ihaka under rule 871 (1)(d) alleging that “ T Ihaka permitted his mount TEXAS to move inward when not clear of MR CHARLTON (G Walsh) near the 900m causing MR CHARLTON to be checked”.

Mr Ihaka indicated on the information he admitted this breach of the rules and he confirmed this at the hearing.  He also agreed he understood the charge and the rule it was laid under.

Chief Stipendiary Steward Mr Sanders showed the film of the incident.  TEXAS was in the lead and approximately one and half widths off the rail.  Soon after jumping the hurdle at the 1000 metres the horse moved inwards causing MR CHARLTON who was racing against the rail to be checked.

Mr Ihaka did not dispute anything Mr Sanders said.

Penalty Submission

Mr Sanders said Mr Ihaka had an excellent record and had not appeared before a judicial committee in four years of race riding.  He pointed out the limited opportunities for jumping/highweight jockeys and thought the matter could be dealt with by way of a suspension of three days.

Mr Ihaka said that since this was his first charge he believed it should be dealt with by way of a fine.

--

When questioned as to his understanding of the seven day deferment rule (Rule1305 (2)) Mr Ihaka said he was not sure he understood the rule.  As a result the hearing was briefly adjourned to allow Mr Sanders to advise Mr Ihaka of the details of the rule.  When the hearing resumed Mr Ihaka advised that he had commitments to ride at Matamata on Wednesday July 1st therefore any suspension could begin after that.

Decision

In coming to a decision on penalty the Committee carefully considered all the submissions. We have given credit for Mr Ihaka’s admittance of the breach and his flawless riding record.
We have also taken into consideration the limited season and opportunities available to highweight riders.
This race however was a Prestige Jump Race – Category 2 and Mr CHARLTON did suffer interference as a result of Mr Ihaka’s actions. It is our opinion that a suspension rather than a fine is the appropriate penalty.

Mr Ihaka is suspended from the close of racing on Wednesday July 1st until the close of racing on Wednesday July 8th – in effect three jumping/highweight days.
