Decision: Following race 4 an information was filed pursuant to Rule 871 (1) (d) by Stipendiary Steward Mr J Oatham that Ms T McMullen, rider of WATERMARK, committed a breach of that Rule when she permitted her mount WATERMARK to shift outwards near the 300 metres when not sufficiently clear
Following race 4 an information was filed pursuant to Rule 871 (1) (d) by Stipendiary Steward Mr J Oatham that Ms T McMullen, rider of WATERMARK, committed a breach of that Rule when she permitted her mount WATERMARK to shift outwards near the 300 metres when not sufficiently clear of PURE STRIKE, ridden by J McDonald, who was checked and forced onto KELLY JONES, ridden by Jason Collett.
--Ms McMullen admitted the breach and was represented by trainer Mr B Foote.
--Stipendiary Steward Mr Williamson demonstrated the video films and showed WATERMARK, ridden by Ms McMullen, shift outwards near the 300 metre mark when not the required distance clear, taking the line of PURE STRIKE causing a check, who in turn checked KELLY JONES.
--Mr Williamson stated Ms McMullen did straighten her mount, but the damage was already done.
--Mr Foote stated it was a minor incident and her mount had moved slightly prior to bumping PURE STRIKE and she took immediate action.
--Ms McMullen had nothing further to add.
--PENALTY
--Mr Oatham submitted a suspension of 4 – 6 days would be appropriate.
--Ms McMullen stated she had confirmed riding engagements for Avondale, 10 September 2008.
--The Committee carefully considered all submissions and before imposing a penalty took into account :
--1. Guilty plea.
--2. Jockey’s record.
--3. Degree of carelessness
--4. The interference suffered by Mr McDonald and Mr Collett.
--Accordingly, the Committee imposed a suspension to be served by Ms McMullen starting after racing on 10 September and to conclude after racing on 19 September, 5 days.
