Following the running of Race 10 information was lodged against J Gray the driver of True Grit. It was alleged that Mr Grey drove in a manner causing interference when moving True Grit out when not clear of Elrae Trebor [B C Hutton] causing this horse to break and lose all chance.

At the outset of the hearing Mr Gray confirmed that he had been assisted in the preliminary hearing by his employer Mr K M Barron and they had viewed the video evidence together and he did not seek assistance from Mr Barron during his hearing. Mr Gray confirmed his guilty plea.

The Stipendiary Stewards demonstrated the incident with the assistance of the video evidence. This showed Mr Gray racing three back on the fence, move out, checking Elrae Trebor causing that horse to break and lose all chance.

With regard to penalty the Stipendiary Stewards submitted that a period of suspension would be appropriate given that Mr Gray was junior horseman and not in a position to pay a financial penalty. The Stipendiary Stewards also acknowledged Mr Gray's early guilty plea and his co-operation at the hearing.

Mr Gray confirmed that he was not in a position to pay any monetary penalty and therefore preferred a suspension.

Giving Mr Gray credit for his early guilty plea and his frankness at the hearing the Committee imposes a suspension from the completion of racing today until the completion of racing on the 18th December 2004 [in effect a two day penalty]
